Answering questions
When asked questions that are relevant to the insurer’s decision to insure you and on what terms, you have a duty to take reasonable care not to make a misrepresentation when answering. This applies to you and anyone else you want to be covered by the contract.
Variations, extensions and reinstatements
For variations, extensions, and reinstatements, you have a duty to take reasonable care not to make a misrepresentation when answering questions.
Renewal
When renewal is offered, the insurer may ask specific questions or provide you with a copy of previous disclosures and request confirmation of any changes. You must inform the insurer about any changes or confirm that there are no changes. If you do not report any changes, it will be assumed that there are none.
What you do not need to disclose
You do not need to disclose anything that:
Reduces the risk the insurer covers.
Is common knowledge.
The insurer knows or should know.
The insurer has waived the duty to disclose.
Non-disclosure
If you fail to disclose information required by the insurer, they may cancel your contract or reduce the amount payable on a claim, or both. If the non-disclosure is fraudulent, the insurer may refuse to pay a claim and treat the contract as if it never existed.
